FOR YOUR RADAR: Amtrak notified the
Surface Transportation Board last week that it's OK with the agency ruling on
pending motions from Norfolk Southern and CSX to dismiss its case against them
for substandard on-time performance of its Capitol Limited service. Amtrak's
decision is based on the Supreme Court declining to take up an appellate
court's decision throwing out an STB rule that
defined "on-time performance" for its trains. The passenger railroad
filed its initial complaint against the freights, which own the tracks over
which the Capitol Limited operates, in November 2014 based on the part of the
law for which STB tried to define timeliness for Amtrak trains. [POLITICO's Morning Transportation, March 16, 2018]
